Terms of Service
These Terms of Service ("Terms") form a legal agreement between you and Night Bass Hunter ("we," "us," or "our") governing your access to and use of the mobile application Night Bass Hunter (the "App"). By installing, accessing, or using the App, you agree to be bound by these Terms.
1. Eligibility
The App is rated Everyone 10+. By using the App, you represent that you are at least 10 years of age or have the consent of a parent or legal guardian. If you do not meet these requirements, do not install or use the App.
2. Nature of the App — No Real Betting
The App is a casual fictional nocturnal-angling collection game. It contains no real-money gambling, no wagering, no cash prizes, no in-app purchases, and no links to real gambling sites. The atmospheric "bayou commentary" is decorative flavor text and does not represent real odds or real bets. Any references to "jackpot," "fortune," or similar terminology are part of the fictional theme and have no real-world value or redeemability.
3. License Grant
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial entertainment. You may not:
- Modify, decompile, reverse-engineer, or attempt to extract the source code of the App.
- Resell, sublicense, distribute, or commercially exploit the App or its content.
- Use automated tools, bots, scrapers, or scripts to interact with the App.
- Bypass, disable, or interfere with security or rate-limit features.
- Use the App in any way that violates applicable laws.
4. User Conduct
You agree not to use the App in a manner that could harm us, other users, or any third party, including transmitting unlawful content, infringing intellectual property, or attempting to access another user's data.
5. Intellectual Property
All content within the App — including artwork, illustrations, fish portraits, the Compass Map, the Tackle Trio symbols, the rank ladder, journal entries, code, fonts, and visual identity — is owned by us or our licensors and is protected by copyright, trademark, and other laws. All fish, regions, and angler imagery are AI-generated and fictional.
6. Virtual Items
Any virtual items in the App (lantern oil, card pulls, star tiers, ranks, expedition badges) have no monetary value and are not redeemable for real-world currency, prizes, or goods. We may modify, reset, or remove virtual items at any time without compensation.
7. Updates and Availability
We may, but are not obligated to, provide updates, bug fixes, new content, or new features. We may suspend, discontinue, or modify the App at any time without prior notice. We are not liable for any unavailability or modification of the App.
8. Disclaimers
The App is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will we, our affiliates, or our licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, or damages (including reasonable legal fees) arising out of your use of the App or your breach of these Terms.
11. Third-Party Services
The App integrates third-party SDKs (Google Play Services, Firebase Cloud Messaging, AppsFlyer, OneSignal). Your use of those services is also governed by their respective terms and privacy policies, listed in our Privacy Policy.
12. Termination
We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. You may stop using the App at any time by uninstalling it.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which we are established, without regard to its conflict-of-law principles. Any dispute arising from the Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
14. Changes to the Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after such changes constitutes your acceptance of the revised Terms.
